1. Foreigners in charge of foreign companies do not need to visit a taxing authority to handle taxpayer registration in person (2015.8.3)

  When a company is already legally registered, in principle, persons in charge of foreign companies do not need to visit a taxing authority to apply for company business registration. If the taxing authority later believes that there is a need for a company’s person in charge to visit the said authority in person to explain the company’s operating situation and to sign before it is allowed to handle uniform invoice proof of purchase receipt related matters, an assignee can be entrusted to handle this matter in accordance with the following regulations:
1. If the business premises shows signs of business operation, the company’s person in charge can entrust an assignee familiar with the company’s operations to handle this matter.
2. If business premises inspection shows no signs of business operation, the company’s person in charge can commission a lawyer, accountant or juristic person from Taiwan to handle this matter.

2. Relaxation of requirements for innovation-driven startups seeking to hire foreign professionals: foreigners that are “professionally trained, self-taught, or who demonstrate special insight and outstanding performance” are exempt from the requirement of five years’ relevant experience. (2015.5.3)

  In order to allow innovation-driven startups flexibility in hiring, on May 1, 2015, the Ministry of Labor promulgated the amended Article 6 of the Qualifications and Criteria Standards for foreigners undertaking the jobs specified under Article 46.1.1 to 46.1.6 of the Employment Service Act. Enterprises that conform to the "Qualification Requirements for Innovation-driven Startups" of the HeadStart Taiwan Project are exempt from the requirement that foreign professionals who are “professionally trained, self-taught, and who demonstrate special insight and outstanding performance” must have five years’ relevant experience.

3. Relaxation of requirements for innovation-driven startups funded by overseas Chinese or foreigner(s) seeking to hire foreign “managers”: the definition of “manager” will not be limited to that of “manager” currently in effect. (2015.5.3)

  In order to promote innovation and entrepreneurship, on May 1, 2015, the Ministry of Labor issued the amended Regulations Relating to the Qualifications and Criteria Standards for foreigners undertaking the jobs specified under Article 46.1.1 to 46.1.6 of the Employment Service Act. According to the amendment, enterprises funded by overseas Chinese or foreigner(s)  that conform to the "Qualification Requirements for Innovation-driven Startups" of the HeadStart Taiwan Project, when hiring foreign managers, will not be confined to hiring “managers”, but may hire departmental assistant-directors or higher ranking personnel, or personnel of an equivalent rank.

4. Relaxation of the capital and revenue requirements for innovation-driven startups funded by overseas Chinese or foreigner(s) seeking to hire foreign managers (2015.4.8)

  According to the Qualifications and Criteria Standards for Foreigners Undertaking the Jobs Specified under Article 46.1.1 to 46.1.6 of the Employment Service Act, enterprises funded by overseas Chinese or foreigner(s) must meet certain capital and revenue requirements in order to hire foreign managers. Companies established for less than one year must possess operating funds in Taiwan of NTD 500,000 or more, or revenue of NTD 3 million or more. Companies established for more than one year must have made at least NTD 3 million in revenue in the past year, or have maintained average annual revenue of NTD 3 million for the past three years.
 Newly established enterprises not yet in the research and development phase often cannot meet the aforementioned capital and revenue requirements. In order to help enterprises attract talent, on April 8, 2015, the Ministry of Labor announced that enterprises funded by overseas Chinese or foreign nationals that conform to the "Qualification Requirements for Innovation-driven Startups" of the HeadStart Taiwan Project are exempt from capital and revenue requirements when hiring foreign managers.

5. Relaxation of the capital and revenue requirements for innovation-driven startups seeking to hire foreign professionals (2015.1.7)

  In accordance with the Qualifications and Criteria Standards for foreigners undertaking the jobs specified under Article 46.1.1 to 46.1.6 of the Employment Service Act, employers seeking to hire foreign professionals must meet certain capital and revenue requirements; for example, companies established for less than one year must possess at least NTD 5 million of capital or at least NTD 10 million in revenue; companies established for more than one year must have made at least NTD 10 million in revenue in the past year, or have maintained average annual revenue of NTD 10 million for the past three years.
 Newly established innovation-driven startups not yet in the research and development phase often cannot meet the aforementioned capital and revenue requirements. In consideration of this fact, and in order to promote innovation and entrepreneurship, on January 7, 2015, the Ministry of Labor announced that innovation-driven startups that conform to the "Qualification Requirements for Innovation-driven Startups" of the HeadStart Taiwan Project are exempt from capital and revenue requirements when hiring foreign professionals.

6. Relaxation of the requirement that foreign professionals hired by innovation-driven startups must have at least two years’ work experience (2015.1.7)

  In order to attract foreign professionals to Taiwan to participate in innovative enterprises, on January 7, 2015, the Ministry of Labor announced that enterprises that conform to the "Qualification Requirements for Innovation-driven Startups" of the HeadStart Taiwan Project are exempt from the at least two years’ work experience requirement when hiring foreign professionals with a bachelor’s degree.
