Title: Operation Directions for Administrative Supervision of Government-Donated Foundations Ch

Content:  

1.   These Directions are established as directives for the administrative supervision task force on government-donated foundations (hereinafter referred to as the “Task Force”) and work teams under the Task Force, and for the supervising agencies in undertaking administrative supervision of government-donated foundations (hereinafter referred to as the “Foundations”) so as to ensure that  the Foundations operate in conformity with their objectives of establishment.

2.   The duties of the Task Force are as follows:

(1)   Reviewing the general administrative rules governing the administrative supervision mechanism for the Foundations.

(2) Advance tasks relating to the administrative supervision mechanism of the Foundations.

(3)   Coordinating and providing consultation regarding the administrative supervision mechanism for the Foundations.

(4)   Reviewing administrative supervision reports, issues or oversight reports submitted by the work teams.

(5)   Submitting an annual administrative supervision summary report for the previous year before August 31 of each year to the Executive Yuan.

3.   The work teams under the Task Force shall carry out the following tasks in accordance with their assignments:

(1) Drafting general administrative rules governing the administrative supervision mechanism for the Foundations.

(2) Completing the annual results and administrative supervision team report for the previous year before June 30 of each year, and submitting it to the Task Force.

(3) Coordinating and providing consultation regarding the administrative supervision mechanism for the Foundations.

(4)   Depending on the necessity of the issues, invite supervising agencies, representatives of relevant foundations or other professionals to attend (or be present in) meetings and present reports; and if deemed necessary, form a team to visit the supervising agencies or the foundations.

4.   The supervising agencies shall undertake administrative supervision of the Foundations in the following manner:

(1)  Draft and amend regulations governing the supervision of the Foundations in accordance with the general administrative rules governing administration supervision of the Foundations approved by the Executive Yuan and submit the same to the Task Force and the respective agencies for the work teams.

(2) Set up a supervision team or assign a unit to undertake matters relating to the administrative supervision of the Foundations, including the establishment of the Foundations, appointment of foundation directors and supervisors and benefit assessment, and deliberate the continuity, merger, establishment and dissolution of the Foundations in view of attainment of each Foundation’s objectives and national development conditions.   

(3) Require foundations under its supervision to turn in annual benefit assessment report for the previous year before April 15 of each year.

(4)   Assign persons with professional knowledge or other qualified persons to conduct documentation review of the benefit assessment reports submitted by the supervised foundations, and invite, if necessary, personnel from relevant agencies, scholars and experts to join the review. The results of benefit assessment will be used as reference for the appointment of directors and supervisors, staff adjustment, and future subsidies (sponsorship) of the supervising agency.

(5)   Conduct onsite audit of the Foundations at least once every three years for each foundation, and include the findings of onsite audit in the administrative supervision report. 

(6)   Complete the annual administrative supervision report for the previous year before May 31 of each year and submit the same to the Task Force and the respective responsible agencies for the work teams. The administrative supervision report shall contain information on the following aspects:

A.  Personnel management.

B.       Financial management.

C.       Performance evaluation.

D.       Rules and regulations.

E.        Other information as required by the supervising agency based on the nature of the Foundation.

(7)   Provide information on the supervised foundations in response to the needs of the Task Force or work teams under it.

5.   The Task Force will prescribe separately the format of administrative supervision report on the Foundations to be submitted by the supervising agencies.
